Please read the terms and conditions carefully before accepting: The following Terms & Conditions are applicable to all the participants of "Win-A-Tablet' campaign, promoted / organized by Living Media India Ltd., (hereinafter referred to as LMIL). The rules can be amended or varied from time to time by LMIL.

• 1. The duration of the campaign is February 03, 2015 to March 31, 2015 .
• 2. By participating you are not assured any free Tablet but you shall have a fair chance of winning a free Tablet by draw conducted at the end of every week
• 3. All residents of India who have completed 18 years of age on the date of entry/participation are eligible to participate in the Offer.
• 4. By entering the Contest, you hereby warrant that all information submitted by you in your Entry is true, accurate and complete in every respect. LMIL reserves the right to verify any information contained in your Entry and/or your eligibility to enter the Contest.
• 5. LMIL reserves the right to disqualify all entries that do not meet the rules and regulations of the Contest. These include entries submitted with invalid or incorrect information.
• 6. LMIL will not be responsible in any way for failure of website backend technology and resultant inability of participation.

  • b.LMIL shall conduct a random draw to select the winners, the random Draw shall be a fully automated process
  • c. The winners will be informed by email address of the winner, furnished in the entry form and through SMS in the mobile number provided by the winner in the entry form
  • d. To claim the prize the winners will have to submit identity proof and address proof
  • e. The prize shall be dispatched through courier
• 7. All the costs and expenses for dispatching the Prize will be borne LMIL and LMIL shall not entertain any claim, whatsoever. The winner is solely responsible for any other expenses related to the acceptance and use of the offer.
• 8. The prize shall be given to the winner on production of valid documents for Photo and ID proof. Any failure on the part of the winner to comply with directions issued by LMIL, shall entitle LMIL, in its own discretion to cancel and forfeit the prize for the said winner and then the same prize will be given to the next lucky winner.
• 9. The Prize shall not be transferable and no request shall be entertained by LMIL for such transfer.
• 10. All decisions by LMIL regarding the selection of the winners shall be final and binding
• 11. Employees of LMIL and its affiliates/subsidiaries, sponsors of the prizes, associated agencies, participating operators and their immediate family members and relatives are not eligible to participate in this Offer.
• 12. Participation implies acceptance of all the terms & conditions associated with the Offer.
• 13. By participating the Participants agree and acknowledge that they have full knowledge about the terms and conditions of the Offer and that LMIL shall not be responsible for any loss or damage suffered by the participants while participating in the Offer.
• 14. Failure by LMIL on enforce any of these Rules in any instance(s) shall not give rise to any claim by any person.
• 15. The Offer shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters in relation to and arising out of the Offer and, or, pertaining to the rules and regulations and, or, the Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator to be appointed by LMIL. The venue of arbitration shall be New Delhi.
• 16. All disputes shall be subject exclusively to Delhi jurisdiction only.
• 17. Any and all incidental charges shall be sole responsibility of the Participant/winner
• 18. LMIL, in its absolute discretion reserves the right at anytime, without giving any previous notice to the participants, to add, alter, modify, change or vary all or any of these terms & conditions, wholly or in part, or to withdraw the Offer.
• 19. The prize(s) for this Offer shall neither be assignable nor transferable under any Cash in lieu of price shall not be paid in whatsoever circumstance
• 20. In case of any dispute or difference in respect of the prize/ selection of winners, the decision of ITGD shall be final and binding on all concerned.
• 21. Apart from the above-mentioned prize/s, nothing else whatsoever shall be provided to the winner. All applicable taxes, levies, cesses, insurances, transfers and other expenses, if any, will have to be borne and paid by the winner.
• 22. This Prize Draw is not applicable in the territory of Tamil Nadu
• 23. LMIL shall on a best effort basis confirm the names/identity of the winners by sending a Mail in the e-mail ID or calling the winners on their Mobile (MSISDN) or Telephone Numbers, which is provided by the participant in the application form. However, if the verification of the identity of the winners is not possible due to any reason(s) including but not limited to, the inability to contact the winner or any other reason beyond the reasonable control of LMIL, the winners may verify the details published at the aforementioned website and intimate the same to LMIL within 7 days from the date of publishing of winner’s list. All prizes shall be claimed by the winners, accompanied with documents specified herein below, from LMIL within 45 days from the date of publishing of the Winners on the website, which shall be send to LMIL through mail by attaching the scanned copy of the. The documents required to be submitted along with the claim by the winner include the following (the document list is only indicative and not exhaustive and LMIL shall be entitled to request the Subscriber to produce such other document/s from the winner as it may deem fit to its sole and absolute satisfaction:
  • i. Identity Proof,
  • ii. Address Proof,
  • iii. PAN Card and

24. Prizes shall be delivered through courier, in the residential address provided in the application form.

25. LMIL at its sole discretion may also waive production of any one of the aforesaid documents

26. Failure to claim the prize within the aforesaid 45 days period may result in disqualification and forfeiture of the prize and/or declaration of alternate winner which is at the sole discretion of LMIL.

27. If the winners fail to claim their prizes or submit the aforesaid documents to claim the prize within an extended grace period of three (3) months from the date of availability of the winners’ details, then LMIL reserves the right to forfeit such unclaimed prizes.

28. In the event that the prizes cannot be delivered the winner(s) can collect them from the nearest place specified by LMIL.

29. This offer in this Offer cannot be used in conjunction with any alternative offer or promotion.

30. The prizes shall not be redeemable for cash, wherever applicable. No requests shall be entertained by LMIL in this behalf. However, LMIL may at its sole and absolute discretion offer as an alternative to the prize, cash or cash equivalent or such other substitute as it may deem fit in the event that the product is not available in the market or other reason whatsoever.

31. The Winner shall be responsible to keep in safe custody the intimation letter and/or confirmations given/ issued to him by LMIL. In case of loss or damage or theft of the same, LMIL reserves the right to issue duplicate(s) subject to such verifications and/or on such other term/s as it may desire.

32. LMIL reserves the right to change/modify/amend the terms and conditions of the Prize at any time at its sole discretion.

33. LMIL, its vendor and/or its subsidiaries shall not be liable to any person or entity for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by the winner or any third party, whether in connection with this Offer, or for breach of any warranty or in tort.

34. LMIL, its vendors and its subsidiaries shall not be responsible for any claim/s arising out of any technical failure/s either before, during, or after the completion of the Offer including but not limited to any technical failures in the telephone lines, failure of servers or the failure to provide the correct Offer score updates or any mistakes arising out of technical snags. Further, LMIL shall not be responsible for any claims arising out of any failure(s) which are beyond the control of LMIL or its vendors.

35. This Offer is subject to force majeure circumstances i.e. act of God or any circumstance beyond the control of LMIL.

36. The Offer is valid subject to the winner complying with all terms, conditions and/or formalities as required by LMIL. Any failure on the part of the Subscriber to comply with the any specified term, condition and/or formality shall render the Subscriber liable for disqualification at the sole discretion of LMIL.

37. LMIL shall endeavor to deliver the prize or its equivalent within 60 days from the date of receipt of all the documents from the winner to the complete satisfaction of the subscriber, in order to process the distribution of the Prize.

38. This Offer is subject to guidelines/ directions issued by Telecom Regulatory Authority of India or any other statutory authority from time to time.

39. LMIL reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this offer or any part thereof including the eligibility criteria at its sole discretion at anytime during it’s validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on the Subscriber.

40. LMIL shall not be responsible for the quality, fitness, merchantability, defect or deficiency etc. of the Prize and no claim or request, whatsoever, in this respect shall be entertained by the LMIL.
